1. Introduction

Elite AI Services LLC ("Company," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Elite Advisor AI mobile application and website (collectively, the "Service").

Please read this Privacy Policy carefully. By using the Service, you agree to the collection and use of information as described here. If you do not agree, please discontinue use of the Service.


2. Information We Collect

2.1 Information You Provide Directly

When you create an account or use the Service, you may provide:

  • Account information: Name, email address, password
  • Professional information: Dealership name, location, years of experience, vehicle brand specialty
  • Pay plan and goal information: Monthly sales targets, pay plan structure (used solely to calculate your personalized coaching metrics)
  • Performance data: Sales amounts, services sold or declined, follow-up records you choose to log
  • Customer interaction data: Service names, vehicle information (year, make, model), objection types, and customer initials and RO numbers you enter during coaching sessions. Customer full names and phone numbers are used during active sessions to personalize communication but are never stored in our database. Conversation transcripts are automatically redacted to remove names and phone numbers before being saved. See Section 4 for full details on how customer data is handled.
  • Communications: Messages you send to our support team

2.2 Information Collected Automatically

When you use the Service, we may automatically collect:

  • Device information: Device type, operating system, unique device identifiers, browser type
  • Usage data: Features used, screens viewed, session duration, interaction patterns
  • Log data: IP address, access times, pages viewed, app crashes and errors
  • Performance metrics: General usage patterns to improve the Service (not tied to individual customer data)

2.3 Information from Third-Party Services

We use the following third-party services that may collect information about you:

  • Stripe (payments): Processes subscription payments. We do not store your full credit card number. Stripe's privacy policy governs their handling of your payment data: stripe.com/privacy
  • Anthropic (AI): Powers AI-generated coaching content and post-session transcript redaction. Prompts submitted to the API are not used for model training under our API agreement. Anthropic's privacy policy: anthropic.com/privacy
  • Twilio (SMS infrastructure): Powers SMS delivery features. We have enabled Twilio's Message Redaction feature, which prevents Twilio from retaining message body content or full phone numbers beyond the 24-hour delivery window. Twilio's privacy policy: twilio.com/en-us/legal/privacy
  • Supabase, Inc.: Provides our cloud database (hosted on AWS infrastructure in the United States). This is where advisor data and redacted customer records are stored. Supabase's privacy policy: supabase.com/privacy
  • Vercel, Inc.: Hosts our application. Data passes through Vercel's servers during request processing but is not stored there. Vercel's privacy policy: vercel.com/legal/privacy-policy

3. How We Use Your Information

We do not use your data or your customers' data to train AI models. Inputs you provide to the Service — including vehicle information, objection types, and customer data — are processed by Anthropic's Claude API to generate coaching responses. They are not stored by Anthropic for model training purposes under our API agreement. Elite AI Services LLC does not sell, license, or share your session data or customer data with any AI model provider for training purposes.

We use the information we collect to:

  • Provide and operate the Service: Deliver AI-generated coaching content, scripts, and performance tracking tailored to your inputs
  • Process payments: Manage your subscription through Stripe
  • Personalize your experience: Customize coaching content based on your dealership, vehicle specialty, and performance goals
  • Calculate your metrics: Generate MTD/QTD/YTD stats, goal progress, and follow-up tracking using data you provide
  • Communicate with you: Send account notifications, subscription confirmations, and service updates
  • Improve the Service: Analyze usage patterns to improve features, fix bugs, and develop new content
  • Ensure security: Detect, prevent, and address fraud, abuse, and security incidents
  • Comply with legal obligations: Respond to lawful requests from law enforcement or regulators

We do not sell your personal information to third parties. We do not use your personal information to serve you third-party advertisements.


4. Customer Data We Process on Your Behalf

The Service allows you to store and manage customer personal information, including customer names and phone numbers, for the purpose of coaching you on follow-up communications and service sales.

4.1 Our Role as Data Processor

When you enter customer personal information into the Service, Elite AI Services LLC acts as a data processor — we process that data solely on your behalf, under your instructions, and for the purpose of providing the Service to you. You, as the service advisor, act as the data controller and are responsible for ensuring your use of customer data complies with applicable law. This processor relationship is governed by our Data Processing Agreement (DPA), which is incorporated into this Privacy Policy by reference.

4.2 What Customer Data We Store

Elite Advisor AI uses a pseudonymized data model designed to minimize the customer personal information stored in our systems. We store:

  • Customer initials (e.g., "J.M.") — not full name
  • RO number — your DMS reference, which you can use to look up the full customer record in your existing dealership system
  • Vehicle information: Year, Make, and Model only — we do not store VIN numbers
  • Redacted conversation transcripts — after each session, an automated process replaces all customer names and phone numbers with anonymized placeholders ([CUSTOMER], [PHONE]) before the transcript is saved to our database
  • Interaction notes and service outcomes you choose to log (services sold/declined, labor/parts amounts)
  • Follow-up scheduling information
  • Consent records (opt-in date, method, and opt-out if applicable) — retained permanently per TCPA requirements

What we do NOT store:

  • Customer full name
  • Customer phone number
  • Vehicle Identification Number (VIN)
  • Customer financial information, government ID numbers, or medical information

How phone numbers are handled: When you initiate an SMS session, the customer's phone number is used in active memory to send and receive messages via Twilio. It is never written to our database. On Twilio's side, we have enabled Message Redaction, which clears message content and phone number data from Twilio's systems within 24 hours of delivery.

4.3 How We Use Customer Data

Customer personal information you enter into the Service is used exclusively to:

  • Display customer records within your account
  • Generate personalized coaching scripts and suggested messages based on the customer's vehicle and service history
  • Schedule and track follow-up reminders
  • Provide you with coaching context during live call or SMS sessions

We do not use customer data to contact those customers directly, sell to them, or share their information with any third party except as necessary to provide the Service (e.g., processing through our cloud infrastructure provider).

4.4 Your Responsibility for Customer Consent

Before entering any customer's personal information into the Service, you are responsible for:

  • Obtaining the customer's consent to store their information in a third-party application for sales coaching purposes
  • Obtaining explicit consent before using their phone number to send text messages
  • Complying with all applicable laws including the TCPA, CCPA, and any dealership or manufacturer data policies

4.5 Customer Data Retention

Customer data is retained according to the following schedule:

  • Redacted conversation transcripts: Auto-deleted on a 12-month rolling basis. Transcripts older than 12 months are automatically purged, regardless of account status. All transcripts are already redacted of names and phone numbers before storage.
  • Consent records (opt-in date, method, opt-out if applicable): Retained permanently as required for TCPA compliance and to defend against any future claims.
  • Customer initials, RO number, vehicle info, and follow-up records: Retained for as long as your account is active.
  • Deleted customer records: Removed within 30 days of advisor-initiated deletion.
  • Account cancellation: All customer data deleted within 30 days of account closure, except consent records which are retained permanently per TCPA requirements.

4.6 Customer Rights

If one of your customers contacts us directly to request access to, correction of, or deletion of their personal information stored in the Service, we will notify you and work with you to fulfill that request within the timeframes required by applicable law. 5. How We Share Your Information

We do not sell, rent, or trade your personal information. We may share your information in limited circumstances:

5.1 Service Providers

We share information with trusted third-party vendors who assist in operating the Service, including:

  • Stripe — for payment processing
  • Anthropic — for AI content generation and post-session transcript redaction
  • Twilio — for SMS delivery (Message Redaction enabled)
  • Supabase, Inc. — for cloud database and data storage (hosted on AWS, United States)
  • Vercel, Inc. — for application hosting and delivery

All service providers are contractually required to use your information only to provide services to us and in compliance with applicable law.

5.2 Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal process (such as a court order or subpoena), or when we believe disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud.

5.3 Business Transfers

In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice in the Service before your information is transferred and becomes subject to a different privacy policy.

5.4 With Your Consent

We may share your information for any other purpose with your explicit consent.


6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. If you cancel your subscription, we will retain your advisor account data (login credentials, profile, pay plan settings, performance history) for up to 90 days to allow for account reactivation, after which it will be deleted or anonymized. This 90-day window applies to your own account data only — customer data follows the shorter schedule in Section 4.5 and is deleted within 30 days of account cancellation regardless of whether you reactivate.

We may retain certain information for longer periods as required by law or for legitimate business purposes such as fraud prevention or dispute resolution.

Performance data and app usage logs may be retained in anonymized, aggregated form indefinitely for analytics and product improvement purposes.


7. Data Storage and Security

Your information is stored on secure servers hosted by our cloud infrastructure providers. We implement industry-standard security measures including:

  • Encryption of data in transit (TLS/SSL)
  • Encryption of data at rest
  • Access controls limiting who can access your data
  • Regular security reviews

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.


8. Your Rights and Choices

8.1 Access and Correction

You may access and update your account information at any time through your account settings in the Service.

8.2 Deletion

You may request deletion of your account and associated personal information by contacting us at jorge@eliteadvisorai.com. We will process deletion requests within 30 days, subject to any legal obligations to retain certain data.

8.3 Data Portability

You may request a copy of the personal information we hold about you in a structured, machine-readable format by contacting jorge@eliteadvisorai.com.

8.4 Opt-Out of Marketing Communications

You may opt out of marketing emails by clicking the "unsubscribe" link in any marketing email or by contacting us at jorge@eliteadvisorai.com. Note that we may still send you transactional emails related to your account and subscription.


9. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

9.1 Right to Know

You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you, the categories of sources from which it was collected, the business purposes for collecting it, and the categories of third parties with whom we share it.

9.2 Right to Delete

You have the right to request deletion of personal information we have collected, subject to certain exceptions.

9.3 Right to Correct

You have the right to request correction of inaccurate personal information.

9.4 Right to Opt-Out of Sale or Sharing

We do not sell or share your personal information for cross-context behavioral advertising. If this changes, we will provide a "Do Not Sell or Share My Personal Information" link.

9.5 Note for Customers of Service Advisors

If you are a dealership customer (not a service advisor subscriber) and believe your personal information has been stored in this Service by a service advisor, you may contact us at jorge@eliteadvisorai.com to request access, correction, or deletion of your information. We will coordinate with the relevant advisor to fulfill your request within 45 days.

9.6 Right to Non-Discrimination

We will not discriminate against you for exercising your CCPA rights. We will not deny you services, charge you different prices, or provide a different quality of service because you exercised your rights.

9.7 How to Submit a Request

We will respond within 45 days of receiving your request. We may need to verify your identity before processing your request.


10. Cookies and Do Not Track

Our website (eliteadvisorai.com) may use essential cookies and third-party services (such as Google Fonts and Google Forms) that may set cookies. We do not use cookies for advertising or behavioral tracking. We do not currently respond to browser "Do Not Track" signals, as there is no consistent industry standard for how to respond to such signals. If you wish to limit cookie usage, you may configure your browser settings accordingly.


11. Children's Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information promptly. If you believe we may have collected information from a child under 18, please contact us at jorge@eliteadvisorai.com.


12. Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before providing any personal information.


13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by displaying a prominent notice in the Service before the changes take effect. Your continued use of the Service after the effective date of any updated Privacy Policy constitutes your acceptance of the changes.

We encourage you to review this Privacy Policy periodically.
